So-Called Legal Scholars Twist Themselves into Pretzels Over Biden Pardon
Rudy Giuliani blasted Joe Biden’s blanket pardon of his son, Hunter Biden. Describing it as “the most scandalous pardon in American history by the most notorious liar in Presidential history,” Giuliani laid out his case on social media and in a fiery video. His critique? The pardon is unconstitutional, overbroad, and reeks of corruption.
The blanket pardon, which Giuliani points out is the first of its kind since President Gerald Ford’s controversial pardon of Richard Nixon, covers “all federal crimes” Hunter Biden may have committed between January 1, 2014, and December 1, 2024. Giuliani argues this sweeping pardon exceeds constitutional limits.
Legal Scholars in the Hot Seat
Giuliani specifically called out Missouri law professor Frank Bowman, who previously criticized blanket pardons as unconstitutional. During the Trump presidency, Bowman asserted, “A pardon of the Ford-Nixon style, which purported to cover every possible violation of federal criminal law, whether or not known to the president issuing the pardon, is a constitutional step too far.”
Now, Giuliani challenges Bowman and others to defend their shifting stances. “I challenge these individuals, including Professor Bowman, to come on and debate with me,” Giuliani said, accusing them of hypocrisy.
Mirroring the Nixon Pardon
Legal analysts, including those at Politico, have noted that the language of Hunter Biden’s pardon closely mirrors Ford’s pardon of Nixon. According to Giuliani, Bowman’s earlier argument should logically apply here: both pardons are unconstitutional. Yet, Giuliani alleges, the same scholars who denounced blanket pardons under Trump are now silent—or worse, defending Biden’s actions.
Corruption Allegations
Giuliani didn’t stop at constitutional critiques. He painted the pardon as part of a larger web of corruption involving Hunter Biden’s foreign dealings and Joe Biden’s alleged involvement.
According to Giuliani, evidence from Hunter Biden’s infamous laptop reveals payments totaling $30 to $50 million from foreign entities, including adversaries like China and Russia. Giuliani claims Hunter himself admitted to giving half of his income to his father—a statement backed by emails and other records.
“This admission is devastating evidence,” Giuliani said. He emphasized that admissions, under the hearsay rule, often carry more weight than confessions.
He also highlighted voicemail recordings where Joe Biden reportedly reassured Hunter about his dealings with China, saying he believed Hunter was “in the clear.” For Giuliani, this is undeniable proof that Joe Biden was aware of and possibly complicit in his son’s activities.
The Strongest RICO Case
Giuliani, a former federal prosecutor with experience in complex RICO (Racketeer Influenced and Corrupt Organizations Act) cases, described the evidence as overwhelming. “This is the strongest RICO case I’ve ever seen,” he said, pointing to texts, emails, and financial transactions that he believes establish a clear pattern of corruption.
He argues that the pardon itself could be construed as obstruction of justice, especially if it was issued to protect Joe Biden from scrutiny. Giuliani called the situation “the single biggest known scandal at the highest levels of our government.”
A Corrupted System?
Giuliani didn’t mince words about the implications of the pardon. He accused the Biden administration of corrupting the judicial system to shield itself from accountability. “This pardon has completely corrupted our judicial system,” he claimed, warning that it sets a dangerous precedent.
What’s Next?
Giuliani’s coverage of the growing controversy surrounding the Biden family’s business dealings and the president’s decision to pardon his son promises to be scathing. Whether legal scholars like Frank Bowman respond remains to be seen, but Giuliani’s call for a debate signals that this issue won’t fade quietly.
In Giuliani’s words, “This isn’t just a scandal—it’s a test of whether our Republic can withstand this level of corruption.”
