Congress initially allocated the funds in 2020 and 2021 during the term of former President Donald Trump. Judge Tipton, appointed by Trump, asserted that the Biden administration’s decision to redirect the funds violated administrative law. He rejected the federal government’s argument that it had discretion in spending the money, emphasizing the need for Texas to demonstrate that the funds weren’t being used for additional border walls, which could potentially deter illegal immigration.
Texas Attorney General Ken Paxton hailed the decision, criticizing President Biden’s handling of the funds and alleging a disregard for border security concerns. Paxton’s statement underscored Texas’s victory in the legal battle, highlighting the state’s efforts to combat open-border policies.
This ruling follows a series of legal confrontations between Texas officials and the Biden administration regarding immigration policies. In 2021, George P. Bush and Paxton sued the administration after President Biden directed a pause in border wall construction.
